A federal judge in NY dealt the Trump administration the second legal defeat in its effort to end Obama-era immigration protections for hundreds of thousands of people brought illegally to the U.S.as children.

U.S. District Judge Nicholas Garaufis in the Eastern District of NY ruled that DACA can not end in March as originally planned by the administration.

The Justice Department appealed the decision, asking the U.S. Supreme Court last month to take up the case quickly, thus bypassing the Ninth Circuit Court of Appeals. A bipartisan offer by six senators that Trump rejected would have made citizenship possible for the 690,000 "Dreamers" registered under the program, nicknamed DACA, which shields immigrants who came to the U.S.as children and stayed here illegally.

He delayed enforcement to give Congress until 5 March to enact a replacement plan for Daca recipients, known as "Dreamers". In fact, a recent court ruling has rendered that deadline meaningless. A clean DACA fix-meaning, one that addresses Dreamers but not border security or legal immigration-could probably pass the Senate with Democratic and a few Republican votes, but whether it would get to sixty, or whether there would be thirty Republicans on board, is an open question, not to mention whether whatever the Senate passes could get by the hardliners in the House.

"This entire immigration debate is created to fail and it will", a Senate aide told NBC News, according to an article published Monday.

Trump declared he would rescind DACA in September, claiming it was unconstitutional.

Garaufis' order, then, overlaps with that of U.S. District Judge William Alsup of the Northern District of California. The APA requires federal officials to offer a reasonable justification before changing a major policy.

The program's March 5 expiration date is not set in concrete, however - a San Francisco judge's injunction has at least temporarily blocked removal of DACA protections ordered by Trump late previous year.
