Paul Manafort's attorney in his civil lawsuit said Wednesday that they want prosecutors to stop indicting him.

Manafort's legal team has argued that Rosenstein inappropriately gave the special counsel's office an unlimited "blank check" when he authorized Mueller last May to investigate any matter that "arose or may arise" from an examination of the Trump team's ties to Russian Federation.

A federal judge on Wednesday appeared skeptical of a civil lawsuit filed by former Trump campaign chairman Paul Manafort alleging that the Justice Department and Special Counsel Robert Mueller exceeded their authority in prosecuting him as part of the sprawling Russian Federation probe. She questioned whether there was a clear limit on how broad a special counsel's authority could be from the get-go; how Manafort had standing to sue over a possible future prosecution that hadn't yet happened; and why he should be able to bring a civil lawsuit when he could make the same arguments in the criminal cases, where he clearly had the right to challenge the indictments. In addition to authorizing the Russian Federation collusion investigation of Manafort, Rosenstein also specifically authorized Mueller to investigate any crimes related to payments Manafort received from the Ukrainian government during the tenure of former Ukrainian President Viktor Yanukovych. Manafort plans to file an updated version of the lawsuit that reflects the narrowed focus and also drops a second count that accused Mueller of exceeding the scope of his authority in the appointment order, according to a person familiar with Manafort's legal team. "Do you have case that supports this?"

Jackson, who didn't rule Wednesday, said the Washington indictment was the "elephant in the room". Manafort is facing charges of tax fraud, bank fraud, money laundering and failing to disclose foreign lobbying related to his work in Ukraine.

Nonetheless, the charges against Manafort have nothing to do with those alleged ties.

A court filing on Monday showed Mr Mueller is specifically authorised to investigate whether Manafort colluded with Russian Federation to interfere with the 2016 presidential election and his ties to Ukraine's former pro-Russia government prior to 2016.

Prosecutors say in their court filing that given their mandate to investigate links between Trump associates and Russian Federation, it was logical and appropriate to investigate Manafort for ties to Russia-backed politicians and oligarchs.

"It would also naturally look into any interactions they may have had before and during the campaign to plumb motives and opportunities to coordinate and to expose possible channels for surreptitious communications", prosecutors wrote. "And prosecutors would naturally follow the money trail from Manafort's Ukrainian consulting activities", they wrote.

In the heavily redacted memo, Mueller argued that Rosenstein "left no doubt that the conduct that forms the basis for the indictment is within the special counsel's jurisdiction".
