BJP legislature party leader B S Yeddyurappa was yesterday sworn-in as the chief minister of Karnataka. In a rare pre-dawn hearing, Supreme Court refused to stop BJP leader BS Yeddyurappa's swearing-in as Karnataka Chief Minister. If Governor Vajubhi Vala has allowed Yedurappa 15 days to prove his majority, he has clearly abused the governor's office.

Amid the fiasco regarding the formation of Government in Karnataka, MLAs of both the Congress and the Janata Dal (Secular) (JD-S) are being shifted to Park Hyatt Hotel in Hyderabad from Bengaluru Resort.

Rohatgi, while reading out then operative part of the 16 May letter sent by Yeddyurappa to the governor, said the BJP leader had said in the letter that the party has emerged as the single largest party in the state and they were willing to form the government.

Hailing the top court's order, Congress President Rahul Gandhi on Friday said that the Supreme Court's order to conduct a floor test in the Karnataka Assembly "vindicated" the party's stand that Governor Vajubhai Vala's acted unconstitutionally.

Supreme Court orders floor test in Karnataka tomorrow evening at 4 pm.

The Congress chief added if the BJP wanted to talk about corruption, it should discuss the Rafale jet deal, BJP chief Amit Shah's son and (Union minister) Piyush Goyal's company.

The BJP's "managers" may get "willing supporters" of BS Yeddyurappa government in the Congress and JD (S) resign from their constituencies.

When the court wanted to know whether staking a claim to form the government with only 104 MLAs would not result in horse-trading, the attorney-general, Mr Venugopal, argued that since the elected candidates had not taken the oath, they were not subject to the anti-defection law. The interim application is likely to be heard on Friday along with the main petition of the combine.

The Congress has sought an appointment with President Ram Nath Kovind on behalf of like-minded opposition parties to appraise him about the Karnataka governor inviting the Bharatiya Janata Party (BJP) to form government in the state even though there was a split verdict in the Assembly election.

At present there are two claimants to power in Karnataka - the Congress-JD (S) alliance claim support of 116 MLAs while the BJP has formed government with 104 MLAs saying that it will prove majority on the floor of the house.

The majority mark is 112 seats. He has given room for the BJP to improve its number tally by attempting to break the Congress Party or the JD (S) and the same can not be done without horse-trading, which is an offence.

Earlier, on May 12 polling for 222 of the 224 Assembly took place across the Karnataka.

Lashing out at the Governor's move, the Congress called it "partisan and biased" and rushed to the Supreme Court for an urgent hearing that commenced at 2.20 a.m. and concluded at 5.30 in the morning.
