The government said that California sought to "second-guess" the federal government and warned "the effect of this state legislation would be to nullify federal law across the country". The California law prevents broadband providers from slowing down or blocking websites, as well as charging higher fees for faster speeds. The Justice Department also said the new bill goes against the federal government's "de-regulatory approach to the internet". "Other states should follow California's lead, and Congress should pass the joint resolution to reverse the FCC's resoundingly unpopular repeal".

Jerry Brown's decision to sign the bill into law has sent Trump into a spin. The lawsuit will decide whether federal or state governments can enact laws that affect national telecommunication companies.

A new law requires publicly traded companies headquartered in California, including Facebook and Google, to include women on their board of directors. The suit was filed on Sunday with the United States District Court for the Eastern District of California.

"When the FCC chose to ignore the millions of consumers who urged them not to repeal net neutrality protections previous year, it left a void that state lawmakers are now rightfully filling", Jonathan Schwantes, senior policy counsel for Consumers Union tells the Times. California joins OR and Washington as states that have successfully passed a net neutrality bill.

"Despite their army of lobbyists and millions spent lining the pockets of legislators, these companies continue to lose ground in the face of overwhelming cross-partisan opposition to their greedy attacks on our Internet freedom".

It was proposed after the Federal Communications Commission repealed Obama-era rules a year ago that prevented internet companies from exercising more control over what people watch and see on the internet.

Senator Scott Weiner, who introduced the proposal in the state assembly, believes that California can defend itself - and the bill - in court, citing past skirmishes against the Trump administration with regards to immigration policies. "The law prohibits many free-data plans, which allow consumers to stream video, music, and the like exempt from any data limits". Brown signed the nation's toughest net neutrality measure Sunday, Sept. 30, requiring internet providers to maintain a level playing field online.
